This document is a summary of the insurance cover provided by the Starr Companies COMMERCIAL DRONE OWNERS/OPERATORS COMPREHENSIVE INSURANCE POLICY and, as such, it does not contain the full terms and condition of your insurance. The full terms and conditions of this insurance can be found in the Policy Wording.

This summary is provided for information purposes only and does not form part of the insurance contract. The Sections of Cover included for an insured Owner or Operator are as detailed in the Policy Schedule.

Insurers

Starr International (Europe) Limited (SIEL)

Starr International (Europe) Limited (SIEL) a member of Starr Companies is authorised by the Prudential Regulation Authority and regulated by the Prudential Regulation Authority and the Financial Conduct Authority.

Important Information That Could Affect The Payment Of Your Claims And Limit Your Coverage

The Insured must observe and fulfil the following Conditions. Failure to do so will mean that Insurers may have no liability to make any payment under this Policy.

Compliance with Air Navigation and Airworthiness Orders and Country Regulations

(i) requirements issued by any competent authority affecting the safe operation of a Drone

(ii) Whilst flying in the United Kingdom the Insureds operations must be compliant with the CAP722 regulation.

(iii) Whilst flying outside the United Kingdom in European Airspace the Operator/Insured must comply with any regulations in force at the time and hold the relevant permit to fly from the relevant Civil Aviation Authority.

(iv) The Insured must comply with any usage regulations in force issued by any Country where the Drone is being operated.

(v) All authorised Drone operators named on this Policy hold a current and up to date CAA approved pilot qualification

(vi) The Insured is approved by the CAA and has permission to operate a Drone.

Policy Section One - Accidental Physical Loss Or Damage

Coverage A:

Accidental physical loss of or damage to an insured Drone.

Extra Benefits included as standard

  • Malicious Damage and Sabotage.
  • Reasonable expenses for wreck removal.
  • Payment for damage to crops and/or other property caused by trespassers following a crash of Your Drone.

This Policy will not cover:

  • Theft of the Drone from premises or a vehicle where force and violent or forcible entry was not required.
  • Damage occurring when the Drone is being Transported unless packed securely in suitable packaging or by other means.
  • Damage to aerial cameras or scanners fixed permanently to the Drone (other than as a result of an accident) due to scratching, fogging or misting of lens.
  • Any damage to the Drone if the lifting weight recommended by the Manufacturer for the Drone make and model is exceeded when any Payload is attached.
  • War, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, martial law, military or usurped power or attempts at usurpation of power;
  • Any hostile detonation of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter;
  • Strikes, riots, civil commotions or labour disturbances;
  • Any act of one or more persons, whether or not agents of a sovereign Power, for political or terrorist purposes;
  • Confiscation, nationalisation, seizure, restraint, detention, appropriation, requisition for title or use by or under the order of any Government; Hi-jacking or any unlawful seizure or wrongful exercise of control of the Aircraft or crew in Flight (including any attempt at such seizure or control).

Coverage B

Accidental physical loss of or damage to Drone spares, engines and equipment.

This Policy will not cover:

  • Loss of or damage to any property fitted to or forming a part of the Drone
  • Loss of or damage to any property which has been detached from the Drone and which is intended to be refitted and not to be replaced by other property.

Coverage C

Accidental physical loss of or damage to property described in the Policy Schedule as Payload. This could include equipment such as cameras etc. that can be attached to the Drone for the purpose of aerial photography.

This Policy will not cover:

  • Physical loss of or damage to aerial cameras or scanners (other than as a result of an accident to the carrying Drone) due to scratching, fogging or misting of lens.
  • (a) Theft of the Payload attached to the Drone from premises or a vehicle where force and violent or forcible entry was not required.

Coverage D

Reconstitution of Data and Reasonable Hire Charges to enable the Insured to continue with his business or operation.

This Policy will not cover:

Reasonable hire charges if the claim is for a total loss.

The Insured must take all reasonable steps to have a suitable data backup process in place, which includes taking back-up copies of all such data at least weekly and have appropriate off site back up in place.

Policy Section Two – Third Party Legal Liability

Coverage E – Public Liability

The Insureds’ legal liability to third parties arising out of the ownership or operation of the insured Drone.

This Policy will not cover:

  • Claims arising out of or in any way connected to Advertising Liability.
  • Claims arising out of wrongful entry or intentional invasion of privacy.
  • Claims arising from nuisance.
  • Any claim caused by noise, pollution, electrical and electromagnetic interference and interference with the use of property.
  • Any claim caused by the actual, alleged or threatened presence of asbestos.

Coverage F – Premises Liability

The Insured’s legal liability to third parties for Bodily Injury or Property Damage caused in or about their premises and elsewhere in connection with their Drone operation or business including cover for the Insured’s vehicles whilst within the confines of an airport or airfield caused by the fault or negligence of the Insured or his employees.

This Policy will not cover:

  • Liability arising from the use of any vehicle upon the public highway.
  • Property Damage to property owned, rented , leased or occupied or whilst being serviced or maintained by the Insured.
  • Any claim caused by noise, pollution, electrical and electromagnetic interference and interference with the use of property.
  • Any claim caused by the actual, alleged or threatened presence of asbestos.

Coverage G – Products Liability

The Insured’s legal liability to third parties when their Drone Products are being handled or used by anyone (other than the Insured) and such Drone Product is no longer in the possession or under the control of the Insured.

The Insured’s Product Liability Coverage will include any advice and services and labour given by them in connection with the Drone.

This Policy will not cover:

  • The cost of repairing or replacing any defective Drone Product manufactured, constructed, altered, repaired, serviced, treated, sold, supplied or distributed by the Insured or any defective part or parts thereof.
  • Loss arising out of improper or inadequate performance, design or specification but this exclusion shall be deemed not to apply to Bodily Injury and/or Property Damage insured hereby resulting therefrom.
  • The cost or expense of the Insured for the inspection, repair, alteration, modification, replacement of or for work completed by or on behalf of the Insured to a Drone Product or any property of which it forms part by reason of a defect or deficiency known or suspected to exist in a Drone Product not actually involved in an Occurrence.
  • Any claim caused by noise, pollution, electrical and electromagnetic interference and interference with the use of property. Any claim caused by the actual, alleged or threatened presence of asbestos.

Coverage H – Extension of Coverage War and Allied Perils Liability

This Extension provides coverage for War risks otherwise excluded by the War and Allied Perils Exclusion in the wording.

This Policy will not cover:

  • Any hostile detonation of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.

Cancellation

Insurers have the right to cancel this Policy at any time where there is a valid reason for doing so by giving the Insured 30 days notice in writing.

Valid reasons may include but are not limited to:

(a) Where Insurers have been unable to collect a premium payment from the Insured. In this case Insurers will contact the Insured in writing requesting payment by a specific date. If payment is not received by that date Insurers will cancel this Policy.

(b) Where Insurers reasonably suspect fraud.

The Insured has the right to cancel this Policy at any time giving Insurers notice in writing. Any return of premium will be calculated in accordance with the Policy cancellation terms.

Limits Of Liability And Coverage

Insurers’ Limits of Liability applicable for each Coverage purchased will be detailed in the Insureds’ Policy Schedule. Insurers will also pay for Defence Costs and Expenses for any Liability claims covered by this Policy.

Excess

The first part of each and every claim which the Insured is responsible to pay for. The Excess amount will be stated in the Policy Schedule.

General Exclusions Applicable To This Policy

The following General Exclusions relate to circumstances where the Insurers will not pay a claim. These apply to all Sections of the Policy unless specifically stated below that they are not:

  • Any loss of use.
  • Any wear and tear, deterioration, mechanical or electrical derangement.
  • Fines, penalties or punitive or exemplary damages
  • Uses not agreed and stated in the Policy Schedule or whilst the Drone is being used for any illegal
    purpose.
  • Use of the Drone outside of the geographical limits agreed and stated in the Policy Schedule.
  • Drones whilst being operated by any person not qualified to operate the Drone.
  • Claims caused by Nuclear Risks.
  • Failure of the Drone or equipment (including any hardware or software) to correctly process data or operate properly due to any failure to correctly recognize any given date.

Duration

The Insurance Policy is issued for 12 Months or such other duration as detailed in the Policy Schedule.

Claim Notification

The Insured should give notice of any event likely to give rise to a claim under this Policy to D2 Associates Ltd as soon as reasonable practicable.

Complaints Procedure

Insurers aim to ensure that all aspects of your contract of insurance are dealt with promptly, efficiently and fairly. At all times Insurers are committed to providing you with the highest standard of service.

Should you remain dissatisfied with the final response from the Insurer, you have the right to refer your complaint to the Financial Ombudsman Service via http://www.financial-ombudsman.org.uk or the Financial Ombudsman Service, Exchange Tower, London E14 9SR.

SANCTION LIMITATION

Insurers will not provide cover or be liable to pay any claim or provide any benefit under this Policy to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose Insurers to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America.

Rights Of Third Parties

This Contract of Insurance does not give any third party person any right to enforce any term of this Contract of Insurance which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999.

Data Protection Act 1998

Any information you have provided will be dealt with by Insurers in compliance with the provisions of the Data Protection Act 1998. For the purpose of providing this Insurance and handling of any claims or complaints which may arise under it, Insurers may need to transfer certain information which you have provided to other parties.

Law And Jurisdiction

Unless specifically agreed to the contrary your Policy shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
